PART I PRELIMINARY

Ordinance may be cited as the Consumer Council Ordinance.

his Ordinance, unless the context otherwise requires--
ncil" means the Consumer Council incorporated by section 3 (1);

PART II INCORPORATION AND POWERS

The Consumer Council existing at the commencement of this
Ordinance is

The Governor may be notice in writing to the Council

The Council shall consist of the following members--
a Chairman who shall be appointed by the Governor for a

The Chairman, Vice-Chairman and any other member

The Council may appoint committees and may delegate to

Appointment of staff and advisers
Subject to subsection (4), the Council shall appoint a person to

The Council may appoint such other employees as it thinks

The Council may make and execute all such documents as may

PART III FINANCIAL
Resources of Council
The Governor may, out of money appropriated for the purpose
by the

of such

The resources of the Council shall consist

Council may, with the approval of the Financial Secretary,

Accounts, audit and annual report
The Council shall keep proper accounts and proper records in

PART IV GENERAL
Council not servant or agent of Crown
Council is not a servant or agent of the Crown and does not enjoy
any
us, immunity or privilege of the Crown.
Governor may give directions
The Governor may, if he considers that the public
interest so
ires, give to the Council such directions as he thinks

ect to the exercise and performance by the Council of its

The Council shall comply with any direction given to

ection (1).
Protection of members of Council and committees
No member or employee of the Council or of any committee
of the
cil shall be personally liable for any act done or default made--
by the Council; or
by any committee of the Council, acting in good faith in the course
of
operations of the Council or of the committee.
The protection hereby conferred on members and employees
of the
cil or of a committee in respect of any act or default shall not
in
way affect any liability of the Council for that act or default.
Prohibition of exploitation of the Council's name for
advertisement
oses
No person shall, with a view to promoting or disparaging any
s, services or immovable property or promoting the image
of any
on, publish or cause to be published any advertisement which
either
essly or by implication makes reference to--
the Council;
any committee, member, agent or employee of the Council;
the Council's publication or finding of tests or surveys
conducted by
n behalf of the Council; or
any other information published by the Council, without
written
ent of the Council.
Any person who contravenes subsection (1) commits an offence
and is
le to a fine of $ 100,000.
For the purpose of subsection (1) "advertisement" may be
constituted
ny words, whether written or spoken, or any picture, drawing,

appearing in any publication; or
brought to the notice of the public or any section of the public

Transitional provisions
All property of whatever kind and whether movable or immovable
vested
r belonging to the Consumer Council existing at the
commencement of
Ordinance shall as from that date vest in or belong to that
Council
ts corporate capacity without any further assurance.
All obligations and liabilities of the said Consumer Council
are as
the commencement of this Ordinance the obligations and
liabilities of
Council in its corporate capacity.
Where anything has been commenced by or under the authority
of the
Consumer Council before the commencement of this Ordinance such
thing
be carried on any completed by the Council in its corporate
capacity.
Every person who immediately before the commencement of this
Ordinance
s an appointment as Chairman, Executive Director or a member of
the
Consumer Council is, as from such commencement but subject to
the
s of his appointment, the Chairman, Executive Director, or a
member of
Council, as the case may be, for the purposes of this Ordinance.
Notwithstanding the definition of "financial year" in section
2 the

《铜陵市征收土地管理办法》已经2008年5月9日市人民政府第7次常务会议通过,现予公布,自发布之日起施行。

铜陵市征收土地管理办法
第一章 总 则
第一条 为加强征收土地管理,维护土地所有权和使用权人的合法权益,确保建设用地征收顺利进行,根据《中华人民共和国土地管理法》等法律法规,结合本市实际,制定本办法。
第二条 本市行政区域内征收土地以及使用转户后剩余土地补偿安置适用本办法。
第三条 市政府建立征收工作联席会议制度,统筹协调征收土地工作,遵循公开公平公正的原则,实行征地规划、征收、储备、供地、管理的统一。
辖区政府负责组织本辖区内土地征收事宜。
第四条 市、县国土资源部门负责征地计划编制、审查报批和监督管理工作,其土地征收办公室负责具体事务性工作。
市政府相关部门按照各自职责配合主管部门做好征收土地工作。
第五条 城市规划建设用地范围内土地实行批次连片征收,条件允许的地方可先转户后安置。
第六条 市、县、区政府建立征收土地专项资金,并负责资金的足额到位,以保障征收工作的正常开展。
征收土地资金使用情况应向社会公开,并接受社会监督和财政、审计、监察部门的依法监督。
第二章 征收调查
第七条 市、县国土资源部门根据土地年度供应计划向辖区政府下达征收通知,同时通知公安部门依法冻结征收范围内户口,通知房地产管理部门停止房屋产权登记,通知征收区域停止各类建设活动。
第八条 辖区政府根据征收通知组织征收调查工作,并按初始登记、初审、审核(认证)等程序进行。
初始登记由村(居)委会对拟规划用地范围内的房屋、人口、宅基地、土地承包经营等情况在7日内完成进行登记造册,并向社会公示,接受群众监督。
初审由乡(镇)政府或街道办事处根据村(居)委会公示结果3日内完成初审,并向社会公示,接受群众监督。
审核由县、区政府根据乡(镇)政府或街道办事处公示结果3日内完成审核,并登报公示,接受社会监督。
征收认证工作由市规划、建设、国土资源、房地产、财政、公安、农业、监察等部门共同实施。需要认证的,由辖区政府提出申请,相关部门根据辖区政府提供的初始登记、初审、审核的相关材料进行认证。
第三章 征收程序
第九条 辖区政府或土地储备机构按照征收报批要求,向国土资源部门申报。
第十条 征收土地由国土资源部门会同劳动保障部门根据土地利用年度计划拟订方案,报送有批准权的人民政府审批。
征收土地方案应告知被征地农民听证权利,依申请举行听证的,听证笔录作为报批资料附件一并上报。
第十一条 市、县政府应在收到征收土地批准文件之日起10个工作日内,在被征收土地的乡(镇)、村、组内以书面形式公告。
第十二条 征收土地公告应包括以下内容:
(一) 征地批准机关、批准文号、批准时间和批准用途;
(二) 被征收土地所有权人、位置、地类和面积;
(三) 征地补偿标准和农业人员安置途径;
(四) 办理征地补偿登记的期限、地点。
第十三条 被征地权利人应在公告之日起15日内,持土地权属相关证件到指定地点,办理征地补偿登记。逾期办理征地补偿登记的,其补偿以辖区政府调查、审核(认证)结果为依据。
第十四条 国土资源部门会同有关部门根据批准的征收土地方案,在征收土地公告之日起45日内,以被征收土地的所有权人拟订征收补偿安置方案,并予以公告。
第十五条 征地补偿安置方案公告应包括以下内容:
(一)征收土地的位置、地类、面积、地上附着物和青苗的种类、数量,需要安置的农业人口的数量;
(二)土地补偿费的支付标准、数额、对象和方式;
(三)安置补助费的支付标准、数额、对象和方式;
(四)房屋和其他附着物、青苗补偿标准及支付方式;
(五)农业人员的安置途径;
(六)农民住房安置点的规划选址;
(七)告知被征地权利人对征地补偿安置方案有权利要求听证。
第十六条 被征地权利人应当在公告后5个工作日内提出申请,国土资源部门收到申请后,应当制作听证通知书,并在举行听证的7日前通知听证参加人举行听证的时间和地点。国土资源部门应当自收到申请之日起15日内举行听证,并将听证笔录及结果与征地补偿安置方案报送同级人民政府审批。
第十七条 辖区政府按照征地补偿安置方案,进行征地补偿、房屋及其他附着物的征迁补偿安置工作。
第十八条 征收土地的各项费用应当自征地补偿安置方案批准之日起3个月内全额支付;被征地权利人应当自征地各项费用付清之日起30日内交付土地。
征收农民承包的土地,农业部门应当依法办理土地承包合同变更手续;国土资源部门根据相关资料接收土地并进入土地储备库。
第十九条 对征迁补偿安置有争议的,由辖区政府协调,协调不成的,由批准征收土地的人民政府裁决,但不影响征收土地方案的实施。
第四章 征收补偿
第二十条 征收土地应依法支付土地补偿费、安置补助费、青苗补偿费和地上附着物补偿费。
第二十一条 土地补偿费按《中华人民共和国土地管理法》的规定,采用被征收土地前3年平均年产值乘以倍数补偿方法计算。(具体补偿标准见附件1)
被征收土地年产值,由市农业、国土资源、物价等部门适时确定,报市政府批准后向社会公布。
第二十二条 土地补偿费属农村集体经济组织成员集体所有。土地补偿费等费用的使用、分配办法应当依照法定程序经本集体成员决定。
征收集体所有的土地,应当依法足额支付土地补偿费、安置补助费、地上附着物和青苗的补偿费等费用,安排被征地农民的社会保障费用,保障被征地农民的生活,维护被征地农民的合法权益。
第二十三条 安置补助费按照需要安置的农业人口计算。需要安置的农业人口,按照被征收耕地数量除以征地前被征收单位平均每人占用耕地的数量计算(具体补助标准见附件2)。
安置补助费必须专款专用,不得挪作他用。
第二十四条 青苗及地上附着物补偿费属其所有者所有(具体补偿标准见附件3),抢种抢栽的青苗不予补偿。
农村道路、农电、水利、管线等农村基础设施经评估后给予补偿。
第二十五条 因建设和地质勘察需要临时用地的,经批准后,根据临时用地范围,按原地类年产值逐年补偿。使用期满后,立即恢复原状,退还给原使用单位,并增补1年年产值补偿费以弥补损失。
第五章 征收安置
第二十六条 各级政府应建立农业人口及耕地动态统计制度,做好征收土地的基础工作。
第二十七条 征收土地需要安置农业人口的,以货币化补偿为主要的安置形式。
第二十八条 下列人员属于征收安置对象:
(一)1995年第二轮土地联产承包调整前户口迁入被征收土地村民组,有承包土地的;
(二)征收时符合下列情况之一的:
1.1995年后出生且父母享有土地承包权的人员;
2.合法婚入的常住农业人口;
3.原常住农业人口的现役士兵(不含军官、士官)、在校学生;
4.法律法规规定的其他应安置人员。
(三)征收转户或村改居前的村民,依法享有土地承包经营权的在籍常住农业人口。
第二十九条 被征收土地人员的名单按征地调查的程序经辖区政府确认后,将应安置人员名册、户籍证明,土地承包合同送交劳动和社会保障部门办理登记,同时报市国土资源部门备案。
第六章 征迁补偿
第三十条 征迁安置对象应为该农村集体经济组织的成员,依法享有宅基地的人员,并符合下列条件之一:
(一)属于征地应安置的农业人口;
(二)征地公告前是该农村集体经济组织成员,但不享有第二轮土地承包经营权的;
(三)征收转户或村改居前的村民,但不享有土地承包经营权的在籍常住农业人口;
(四)法律法规规定应予安置的其他人员。
第三十一条 符合征迁安置对象的,征迁合法的房屋给予补偿。其中30平方米与政府置换新房,剩余的房屋支付补偿款。
第三十二条 房屋补偿标准(含房屋装潢、水、煤气、电、厨、卫)平房均按不超过每平方米500元,楼房按不超过每平方米800元进行补偿;房前屋后的附着物按每人1000元补偿。
房屋的具体分类及补偿标准由县、区政府制定。
征迁过渡费每人每月120元,回迁安置期限超过18个月的按每人每月240元。
第三十三条 集体土地范围内的住宅房屋从事商业、生产等活动的,由被征迁人负责搬迁,对其生产、经营的设施搬迁不予补偿。
第三十四条 集体土地范围内集体性质的非住宅房屋,按住宅标准以实际面积补偿,不予安置。
第三十五条 非集体组织成员,具有使用权证或有关批准证件的合法房产所有者,房屋按实际面积补偿,不予安置。
第三十六条 具备规划与用地手续,且有工商营业执照的合法生产、经营用房及社会事业用房征迁实行货币化补偿。
第三十七条 违法建筑物、构筑物不予补偿。
第七章 征迁安置
第三十八条 征迁安置一般遵循就地就近安置的原则,并采取以下方式进行:
(一)实行货币化安置的,按上年同类同地段商品房均价结算,商品房均价每年由市政府公布;
(二)实行统一征迁、统一建设的,按下列方式安置:
1.符合第三十条第一项规定的人员,按人均30平方米的建筑面积实行产权调换,由政府无偿提供(人均征迁房屋不足30平方米的按30平方米计算);经个人申请可按上年度建筑成本均价增购,人均增购不超过15平方米。建筑成本均价每年由政府公布。
2.符合第三十条第二、三项规定的人员,按人均30平方米的建筑面积实行产权调换,由政府无偿提供(人均征迁房屋不足30平方米的按30平方米计算)。
(三)实行自拆自建的,城市规划建设用地范围外的线性工程等单独选址的零星征地,按规划选址无偿提供宅基地,经审批每户宅基地面积不得超过160平方米,按新农村规划要求,由县、区政府组织实施。
在征收安置时领取独生子女光荣证和二女节育的家庭可按照有关规定给予征迁安置奖励。
第三十九条 对不属于安置对象在农村购买住房或农民宅基地的,征迁时不予安置,并按以下方式处理:
(一)本市居民没有住房且没有享受过房改政策的,优先申请经济适用房或廉租房;
(二)对不符合申请经济适用房或廉租房的,由县、区政府负责搬迁。
第四十条 征迁安置房建设按属地管理,由县、区政府负责实施。
第八章 征迁管理
第四十一条 征迁房屋遵循初始登记、初审、审核,实施拆除的程序(县、区政府采取数据保全措施),并实施补偿安置。
第四十二条 辖区政府应当及时将征迁范围、期限、安置方案、被征迁房屋面积、搬迁时间、搬迁序号、回迁安置时间、地点等事项予以公告,并做好宣传解释工作。
第四十三条 征迁房屋由辖区政府统一组织,由持有拆迁资质单位统一拆除。旧材料回收款用于弥补拆迁工作经费不足。
第四十四条 辖区政府要与被征迁人就补偿安置相关事宜签订协议,并负责档案的整理保管工作。
第四十五条 被征迁人应按要求组织自行拆迁;逾期不拆迁的,由乡(镇)政府和街道办事处帮助其拆除;仍拒绝拆除的,由县、区政府责令其限期拆除。
第九章 罚 则
第四十六条 无权批准征收、使用土地的单位或者个人非法批准占用土地的,超越批准权限非法批准占用土地的,不按照土地利用总体规划确定的用途批准用地的,或者违反法律规定的程序批准占用、征收土地的,其批准文件无效,对非法批准征收土地的直接负责的主管人员和其他直接责任人员,依法给予行政处分;构成犯罪的,依法追究刑事责任。
非法批准、使用的土地应当收回,当事人拒不归还的,按非法占用土地处理。非法批准征收、使用土地,对当事人造成损失的,依法承担赔偿责任。
第四十七条 侵占、挪用征地补偿费用和其他有关费用,依法给予行政处分;构成犯罪的,依法追究刑事责任。
第四十八条 实施征地拆迁补偿安置的有关工作人员应当认真履行职责。对滥用职权、玩忽职守、徇私舞弊的,给予行政处分;构成犯罪的,由司法机关依法追究刑事责任。
第四十九条 被征地权利人应当自征地各项费用付清之后,在规定的期限内交付被征收土地。逾期未交土地、拒不拆迁的,由国土资源部门限期拆迁责令交出土地,拒不交出土地的,依法申请人民法院强制执行。
第十章 附 则
第五十条 本办法自发布之日起实施至满五年止。2004年12月1日市政府发布的《铜陵市征收土地管理办法》(铜政〔2004〕1号)同时废止。
本办法实施前已公布征迁补偿安置方案的,按照公布的方案实施。
